USER AGREEMENT

The text of this User Agreement, which is permanently posted on the Internet at https://givinschool.org, contains 

all the essential terms and conditions and is an offer of Sevostianov Sergei Vyacheslavovich (PSRNSP 318774600136482) 

to conclude a gratuitous contract for information services with any third party using the site https://givinschool.org,

 including all subdomains on the following terms.

Please read this User Agreement carefully before using the https://givinschool.org Website, or its subdomains. 

If you do not agree to the terms of this Agreement or do not have the right to enter into a contract, 

you must immediately cease any use of the Website https://givinschool.org, or its subdomain.

1.1. This User Agreement is a public offer in accordance with paragraph 2 of art. 437 of the Civil Code of the Russian Federation.

1.2. The following terms and definitions apply to this document and the resulting or related relations of the Parties:

       1.2.1. Service – a set of functions of the software and hardware of the Owner, including the Site and the Content, to which the User is granted access to receive the information service.

       1.2.2. Site – an automated information system available on the Internet at the address (including subdomains) https://givinschool.org. 

       1.2.3. User – a person who has concluded this Agreement and/or any other person for whom you have entered into this Agreement with the Owner in accordance with the requirements of the current legislation and this Agreement.

       1.2.4. Content – any information materials, including text, graphic, audiovisual and other materials, which can be accessed using the Service.

1.3. Use of the Service by any means and in any form within its declared functionality, including:
viewing the Content within the Service:

Creates a contract under the terms and conditions of the document User Agreement (Terms of Use) and the Mandatory documents specified herein, in accordance with the provisions of Articles 437 and 438 of the Civil Code of the Russian Federation.

1.4. By using any of the above-mentioned opportunities of the Service, the User confirms that:

       1.4.1. He/she has familiarized himself/herself with all the terms of this Agreement and the Mandatory Documents specified in it before the use of the Service.

       1.4.2. He/she fully accepts all the terms and conditions of this Agreement and the Mandatory Documents specified in it without any exemptions and limitations on his/her part, and undertakes to comply with the Terms of Use, or terminate the use of the Service.

2.1. A mandatory condition for the conclusion of this Agreement is that the User fully and unconditionally accepts and complies with the requirements and provisions defined by the Personal Information Processing Policy posted on the Internet at https://givinschool.org , which contains the rules for the provision and use of confidential information, including personal data of the User.

2.2. The Owner has the right to set limits and introduce other technical restrictions on the use of the Service, which from time to time will be brought to the attention of users in the form and in the manner chosen by the Owner.

By agreeing to the terms of this User Agreement, the User understands and acknowledges that:

3.1. The provisions of the legislation on the protection of consumers’ rights can not apply to the relations between the Parties when the Service is provided on a gratuitous basis.

3.2. The service is provided “as is” for use in information purposes, which implies no guarantees that the Service will meet all the requirements of the User, or that the services will be provided continuously, quickly, reliably and without errors; or that the results/reports that can be obtained using the Service will be accurate and reliable; or that the quality of any product, service, information and Content obtained using the Service will meet the User’s expectations; or that all errors in the Content and / or the software of the Service will be corrected.

3.3. As the Service and its functionality are regularly updated, the form and nature of the services provided may change from time to time without prior notice to the User. The Owner has the right, at his own discretion, to terminate (temporarily or permanently) the provision of services (or any separate functions within the framework of services) to all Users in general or to you, in particular, without your prior notification.

3.4. The User has no right to take the following actions independently or with the involvement of third parties:

       3.4.1. to copy (reproduce) in any form and way the computer program and databases included in the Service of the Owner, including any of their elements and Content, without the prior written consent of their owner;

       3.4.2. reverse-engineer the technology, emulate, decompile, disassemble, decrypt, and perform other similar operations with the Service;

       3.4.3. create software products and / or services using the Service without obtaining the prior permission of the Owner.

3.5. If you find any errors in the functioning of the Service or in the Content posted in it, please report this to the Right holder at the address indicated in the contact section or directly to the Service Support on the Site.

3.6. Under any circumstances, the liability of the Owner is limited to 500 (Five hundred) rubles and is imposed on the Owner solely in the event of guilt in his actions.

4.1. The User agrees to receive information messages (hereinafter referred to as “notifications”) from the Owner to the e-mail address and / or the telephone number specified by the User when using the Service.

4.2. The Owner has the right to use notifications to inform the User about changes and new features of the Service, about changes in Terms of Use or in the Mandatory documents specified herein, as well as for the purposes of information or advertising newsletters.

5.1. This User Agreement, the procedure for its conclusion and execution, as well as issues not regulated by this Agreement are governed by the current legislation of the Russian Federation.

5.2. All disputes over the Agreement or related to it are subject to settlement in court at the location of the Owner in accordance with the procedural law of the Russian Federation.

5.3. This Agreement may be unilaterally changed or terminated by the Owner without prior notice to the User and without payment of any compensation relating to it.

5.4. The current version of this Agreement is placed on the Owner's Website and is available on the Internet at https://givinschool.org/.
